A federal judge has denied a motion to delay Tracy Morgan’s civil lawsuit against Wal-Mart, according to FOX Atlanta. Kevin Roper, the driver of the Wal-Mart truck that crashed into Morgan’s limo in New Jersey in June, filed the motion in hopes of delaying the lawsuit until his criminal trial is over. The investigation into the collision has revealed that Roper was going 65 mph in the 60 seconds before the crash in a 45 mph zone. As a result of the accident, Morgan and two others were seriously injured, and comedian James McNair was killed.
