A civil lawsuit filed against the City of Dallas and the Dallas Police Department for the death of Tobias Mackey is set to begin soon, according to NBC DFW. Mackey was shot nine times by a Dallas police officer in October 2010 while the officer was investigating an unrelated criminal activity outside of his apartment complex. Dallas Police claim that the unarmed Mackey did not follow police orders; however, Mackey was cleared of any wrongdoing in the incident. The officer involved was also never indicted by a grand jury, though he did resign afterwards. Jury selection is still taking place before the trial begins, which is expected to last all week.
