On New Year’s Day in 2013, Larry Davis was pulled over by Austin police for running a stop sign near Interstate 35 and Highway 290, and he was arrested for suspicion of intoxicated driving, despite blowing a 0.0 on a volunteer breath test. According to WFAA News, his blood test, which tests for seven drugs, was also negative. Still, Davis spent the evening in jail and spent the next year battling a criminal case. Police operate on a take-no-chances policy, which has resulted in about 30% dismissal rate; Davis’ case is very unusual, according to police, because of his negative blood and breath tests. Davis and his attorney plan to file a grievance against the officer that arrested Davis.
